The man asserting that Seth Tobias was murdered has passed a polygraph test.

Bill Ash, who worked as an assistant to the hedge fund millionaire, has claimed Tobias was murdered by his wife Filomena. Debra Opri, the attorney representing Ash, said she asked Ash to take the test in order to support his claim.

Opri, who has represented the mother and father of King of Pop Michael Jackson, said it is “only reasonable to conclude with certainty” that Ash has been truthful considering that he passed the test.

Tobias died at 44 in September of what was first believed to be a heart attack he suffered while swimming in a pool at his Florida mansion. A subsequent legal battle between Filomena and the Tobias family for the Tobias fortune brought forth the allegation by Ash that Filomena had murdered her husband by luring a drug-impaired Tobias into the pool with the promise of arranging a sexual encounter with a gay go-go dancer.

That contention, coupled with the revelation that Tobias led an excessive lifestyle during a volatile marriage to Filomena, has scandalized the legacy of Tobias, the successful Circle T founder and CNBC financial commentator. Filomena has denied murdering Tobias and her legal team has tried to prevent Ash from serving as a witness in the battle for the $25 million Tobias estate. Police have yet to render a verdict on how Tobias died.

Ash, 41, has asked for a delay in testifying until after additional toxicology testing has been completed. He has claimed Filomena confessed to murdering Tobias to him and has said he is compelled to seek justice for Tobias.
